Do not get panic, there is no hard and fast rule that they will ask for RFE in ur case. Say if they come up with RFE they will ask ur employer to support with financial status as 140 is employer based, some time they approve ur 140 with out any hassle, so best of luck. Keep ur fingures crossed.

While filling the Labor my attorney used my education (Bachelor's degree BSc Comp Science and one year of diploma in computer science) and as well as the experience which was 8 yrs in 2008 for EB3. Then my labor got approved. So we applied for I140, then USCIS had an RFE on my case saying this education is not enough so my attorney prepared some documents showing this BSc Comp science is equivalent to US 4 yrs degree. Then in a month time immediatly I got my I140 denied, So after that my attorney appealed with I290 form, Still got rejected in 3 months then again my attorney re-appealed to it by adding some more information to it. So now the status is showing as Initial review with AAO.

Guys, I am in the same boat with my passport expiring in 2007. I will have to get a new passport since the current one was already valid for 10 years (issued in 97).
Does any one here have any experience / ideas on how long it takes to get the new passport from the consulate here ?

It took me just three days to get the passport from New York. I sent it by "Next Day" USPS on Monday (there was an option to get it delivered by "Next Day" USPS) and I got it back on Thursday by 10:00 a.m.

I think you misunderstood a point made there. Though it is possible to extend renew H1 for employer if EAD was used some time, but that is like recapturing that status and means fulfilling the terms of H1, by giving up on part time job.
You cannot be on H1 and use EAD for second job at the same time.

SOMEONE PLEASE ADVISE!!!!
My employer got back to me today & informed me that based on the advise of the attorney they will not be providing me a copy of the I-140. He understands that I can leave the company anytime & that he would never hold me back. My question is if there is any other way of getting a copy of the I-140? Is a copy of either the approval notice or the receipt number critical?

As veni001 stated to extend H1B beyond 6 yrs don't we need to have Approved 140? and you said your 140 was withdrawn after approval. So withdrawn 140 has no effect on H1B extension. Can we find out the status of namecheck from USCIS or from any FBI website during retrogresssion. I applied 485 an year ago. Can i find out if atleast the name check is cleared even though my PD is not current.
They usually initiate the name check process shortly after filing I-485.
Since yours was filed a year ago, then of course it would be very interesting to know your status regarding the damn name check, retrogression or not.
However, this info is not always easy to get. You might try several ways: call Customer service, make Infopass appointment...In the ultimate case, you will have to ask your Congressman to inquire for you...
I personaly e-mailed USCIS California Center (CSC-XII.485@dhs.gov). What's really weird is that the first two times they responded within a week but the third time, when I "naively" asked if they could expedite that name check, the reply was an automated message:
"we no longer reply to e-mails, for all inquiries call Customer service bla bla bla..."!!!
I suppose I was just lucky the first times! The third time maybe they just got fed up with my "stupid" questions??!!:confused:

If you ask for a new I 94 you can get it from POE (provided I 94 is about to expire ). I got a new one while entering from Mexico last week. went out and came back in same day .

Please stop complaining, multiple posting of same greivance and try to do something constructive - I have been waiting for more than 5 years now too, and as frustrated as I am, I do not feel complaining will get me anywhere.
Folks, I agree that while complaining and venting are therapeutic, they are only good up to a certain point. Don't just vent on these forums. Vent, but also try and do something constructive - help recruit new members, help raise funds for UIV, talk to your bosses at work and friends who are US citizens, and make them aware of what LEGAL immigrants who are stuck in backlogs and limboland are going through. Have them write their congressmen and senators and tell them to do something about this situation.
Venting is a good first step, but we'll all need to be more constructive than this.

of the passage of the US-India civil nuke deal for us here is that with this piece of legislation out of the way, IV should find it easier to draw upon the resources of the USINPAC and India caucus.
Before this bill's passage, I doubt anyone from Indian caucus/influencial Indians with serious connections in congress would have bothered to listen to or do anything for IV.
Now that its done, we should find it easier to draw upon the strength of India caucus.
IV is not india-specific. But fact remains that Indians are among the worst affected w.r.t. current skilled immigration policies. If we can use that as our strength and draw upon the resources of India caucus/indian-american community, everyone here benefits.
