logiclife, I am not sure whether we can file the 485 on our own with a letter from the employer. The letter from the employer is part of the "Initial Evidence" required to file the 485 petition. Here is a snippet from the immigration-law website talking about the importance of submitting the initial evidence at the time of filing. There is a high possibility that your I-485 petition will get denied(without an RFE) if you don't submit it without a letter from the employer.

Last time we renewed we lost more than a month since they did it from approval date. Also they gave it so fast and only for 1year - we missed the 2yr valid EAD by days. In comparison they issued the AP quite late taking their sweet time

Hey guys,
See guys, My original LC was approved with PD of 2003 from this same company but I-140 was denied due to A2p and now is in appeal. This lc sub is from other worker with lower salary and he left the company 3 yrs ago and I am still working here. It's not like a desi consultancy where they sell approved labor, hold your h1 so you can't transfer your h1, get pay cut and put innocent people's status in jeopardy and create problem for everyone else who want to do LC sub in a honest way. It's a genuine LC substitution and I want to do it as long as the law allow me to do that.
I am also fraustrated with USCIS messed up policy of doing whatever they want and hopefully something will work out for all of us in good way!

Thanks for the information. I have sent a personal e-mail to Senator Chambliss following up on the phone conversating and requesting a meeting. I have also sent personal e-mails to my other representatives. I will call them on Friday.

The eventual fate in the house of the immigration provisions in S1932 has indeed created the false impression in the senate that these issues were addressed in the bill. Keep up the good work, its important that we get the message urgently to the different senate offices given that Senator Frist indeeds to have one of the Comprehensive Immigration bills debated on the senate floor starting this coming Monday (March 27th)

The upper portion is not required for visa stamping either. The bottom portion has all the info required.

Hello All,
I have my H1B stamp and my wife has a H4 stamp from my old employer valid until December 2007. I transferred my employer in Jan 2007 and have a new I-797 valid until 2009. My wife now wants to travel outside the country and come back in a month (September 2007). Can she travel with her current stamping? What documents does she needs at the port of entry when she comes back (my I-797?). Would appreciate very much if someone can help. This is fairly urgent since she has to travel next week.

In my opinion, when it comes to the world of digital photography "best" is almost always classified as a "user's personal opinion" on quality, options, price etc. Not to mention when and what type of photography the camera equipment is going to be used for. I know I am clearly not making it as easy as 1,2,3...but tend to side with what the others in the forum have mentioned in previous forums. (you can do a search for previous posts.) I might add that it will also be beneficial to read and stay abreast of some of the photography publications and of course forums such as Dphoto, which now-a-days most, if not all, do a comprehensive list of tests and trials with cameras ans are frequented by many pro's.
However, I always find it amusing that the different publications seem to choose different cameras as thier "top winner"...talk about personal opinion. I recently came across a review of a camera in which the tester had the camera for nearly one year, in which he was able to give a pretty comprehensive review, while I have read other reviews in which they had the camera for a couple of days (and had two totally different reviews). Lastly, if you stay afloat of the industry and review dphoto I am confident you will be able to develop e better understanding of cameras in the current marketplace and future releases.
So, what are you projecting to use the camera for? It's alright not to know exactly, since we all change our minds, but it's a good place to start since some subject matter needs the faster shutter speeds, while others need better glass (lenses).
I hope some of the additional information I have provided you gives you a better insight about the purchase. For additional info, I did write about some of the general differences between an independent mom and pop shop and a large corporate store which can be found inthe forum.

Makes sense but a couple of my friends who traveled during the winter break and came back through ATL did not have an issue, so that was where I was coming from.
As i said you may or may not have an issue. Makes common sense to carry documents if you do get asked. I had issues when i came through IAD in Apr 2009. Things may have improved during the interim. I know of friends of mine who had no issues on AP and i also know of a GC Holder who got stuck in immigration for 5 hours. I guess it just depends on what kind of person is the POE officer in the secondary inspection room

Its really requires lot of planning and a tough decision to make. Some of our friends say you get good package if you find the job while you are in US and then go.
It does need planning. I am hoping I could find some opportunities here before I decide to take the 'search in India by being there' route, thus my post to ask folks if they know of any such positions.

If I remember correctly (read somewhere on this forum) the strategy should be that you take a infopass appointment on the same day as your finger
printing appointment, talk to the immigration officer and ask him about your wife's FP appointment. If it was indeed sent out and you havent received it he can give you some kind of a receipt(?) and both of you can have the FP done on the same date.

I think getting salary regulary but salary slip after three or more months is common scenario in industry (deleberate attempt by employers, so that H1B transfer can't be filed). I have faced this music, my kid facing it and I am sure many people facing this.
I was lucky to go about it, USCIS did not ask at the time of transfer. Need to get idea, how others have handled it. Does bank statement work in this case?

I would advise against going outside of your district to apply.
If you are going to go via drop-box then they may not even accept your applications for stamping based on your Kerala address on your form for H1. If they do, they could very well reject it and ask you to go to Chennai consulate.
Why would you want to risk that?

a) Is there E- renewals? What about photographs for such renewals?

DOL claimed that the newspaper ad was sent to them without the date of it. So we sent them back the whole paper-page where the date is usually printed at the very top with my job ad on it.

I would suggest that a very slight amount of fill flash would make the eyes not be so dark. However, if you have a decent photo editing program, you could experiment with the "dodge" function to selectively lighten the eyes just enough to make them come out of the shadow, but not enough to be obvious. Also, consider attempting some "soft filter" attempts in said imaging program, to make the portrait more flattering (in other words, to subdue some facial imperfections).

No. If you receive the CPO email, then approval is guaranteed, whether the online status changes or not. For some people, including my two dependants, there was neither the CPO email nor the status change, but the cases got approved.

My wife has a similar situation. We tried to convince school that we are qualified under "parolee" category. However, my wife's I-94 expires (she entered US using AP last June). Her school uses this reason to reject again. Now, we decide to re-enter US again to get a fresh I-94.
Her school officials say that they are going to query USCIS database once my wife gets a new I94 stamp. It is something called G-845 form.
Just curious, did you school query USCIS database on your case? Or your school just think yo are qualified?
I think the "parolee" category is really ambiguous, since it requires student to enter US with parole for at least one year. On the other hand, it wants I-94 unexpired. AP can hardly fit into this category, as if we entered US, the valid length is usually less than 1 year, unless we re-enter US on the exact same date when the AP was issued.
Please, if anybody successfully convinced school on FAFSA, please share your experience here!
